How To Apply For Green Card For Spouse Through Adjustment Of Status (AOS)

Adjustment of Status (AOS) is a process of changing non-immigrant visa to permanent residence aka Green Card. You can apply for adjustment of status for your spouse if they are within US and they entered the US legally. It does not matter if your visa is now expired. As long as you entered lawfully you are eligible to apply for adjustment of status with USICS.

 

Once you meet the eligibility criteria you then file for an adjustment of status by filing form I-485 seeking permanent residency. You will then have to submit an affidavit of support for your spouse. You will also have to show proof that you have enough funds to support your spouse. Your spouse will then have to go through medical examination, and vaccinations. 

 

You also have the option to apply for employment authorization and travel permit but not necessary.

 

Once your application is submitted successfully USICS will notify and set up an appointment for your spouse to go for biometric screening.

 

Finally, you will have to appear for an in person interview. This is the last step. This is where they verify that all the information you filled is true and that nothing has changed since then that makes your spouse ineligible for adjustment of status.

 

After your interview is completed, all formalities completed, paper work submitted and fees paid USICS will inform you of their decision.

 

If the adjustment of status is denied for any reason you can apply for a review through administrative and/or judicial appellate process. This is one big advantage over consular processing. The decision of consular processing is final and cannot be appealed.

 

But if you have done your paperwork right and meet the criteria for eligibility there is a good chance your status change will be approved and you will be mailed a permanent resident card also known as a Green Card.
